An Act to amend the Punjab Transparency and Right to Information Act 2013 (XXV of 2013)

PUNJAB TRANSPARENCY AND RIGHT TO INFORMATION (AMENDMENT) ACT, 2021
No. PAP/Legis-3(55)/2021/2494.–The Punjab Transparency and Right to Information (Amendment) Bill 2021, having been passed by the Provincial Assembly of the Punjab on March 02, 2021, and assented to by the Governor of the Punjab on March 16, 2021, is hereby published as an Act of the Provincial Assembly of the Punjab.
Whereas it is expedient to amend the Punjab Transparency and Right to Information Act 2013 (XXV of 2013), for the purposes hereinafter appearing;
Be it enacted by Provincial Assembly of the Punjab as follows:
1. Short title and commencement.–(1) This Act may be cited as the Punjab Transparency and Right to Information (Amendment) Act 2021.
(2) It shall come into force at once.
2. Amendment in Section 5 of Act XXV of 2013.–In the Punjab Transparency and Right to Information Act 2013 (XXV of 2013), hereinafter referred to as ‘the Act’ in Section 5, for sub-section (6), the following shall be substituted:
“(6) A Commissioner shall hold office for a term of three years extendable for another three years.”
3. Amendment in Section 6 of Act XXV of 2013.–In the Act, in Section 6:
(i) for sub-section (4), the following shall be substituted:
“(4) While inquiring into a complaint, any Commissioner subject to distribution of work by Chief Information Commissioner or any other person authorized by the Commission, may examine any information on spot.”; and
(ii) for sub-section (6) the following shall be substituted:
“(6) The Commission shall prepare an annual report on the implementation of the provisions of this Act during a financial year by 31 August and shall lay it before Provincial Assembly of the Punjab.”.
