The Competition Commission (Salary, Terms and Conditions of Chairman and Members) Rules, 2009

S.R.O. 143(I)/2009.- In exercise of the powers conferred by section 17, read with sub-section(5) of section 14, of the Competition Ordinance, 2007 (LII of 2007), the Federal Government is pleased to make the following rules, namely:—

1. Short title and commencement.- (1) These rules may be called the Competition Commission (Salary, Terms and Conditions of Chairman and Members) Rules, 2009.

(2) They shall come into force at once.

2. Definitions.- (1) In these rules, unless there is anything repugnant in the subject or context,—

(a) “Chairman” means the Chairman of the Commission appointed under sub-section (2) of section 14 of the Ordinance;

(b) “Commission” means the Competition Commission of Pakistan established under section 12 of the Ordinance;

(c) “Member” means a member of the Commission appointed under sub-section (2) of section 14 of the Ordinance;

(d) “Ordinance” means the Competition Ordinance, 2007 (LII of 2007);

(e) “MP-I Scale” means the MP-I Scale notified by the Federal Government; and

(f) “Schedule” means Schedule to these rules.

(2) Words and expressions used in these rules but not defined herein, shall have the meanings assigned to them in the Ordinance.

3. Appointment, experience and qualification of Chairman and Members.- (1) No person shall be appointed as a Member unless that person possesses a post-graduate degree in the relevant field from a recognized institution and has professional experience not below ten years in the areas of accountancy, commerce, economics, finance, industry, law or public administration.

(2) The Members shall be appointed by the Federal Government in consultation with the Chairman.

(3) The Chairman and Members of the Commission shall be appointed for a term of three years and shall be eligible for re-appointment for such term or terms as the Federal Government may determine:—

Provided that the Chairman and Members shall cease to hold office on attaining the age of sixty-five years or expiry of the term whichever is earlier.

4. Salary, terms and conditions of Chairman and Members.- (1) The salary of the Chairman shall be fixed at the maximum of MP-I Scale.

(2) The salary of the Members shall be fixed at the median of MP-I Scale and they shall be entitled to annual increments earned in the normal course in terms of the MP-I Scale.

(3) All other terms and conditions of service of the Chairman and Members shall be in accordance with the Schedule, as may be revised by the Federal Government from time to time.

FACILITIES

 

1.

One Chauffer Driven Car maintained at Corporation’s expense for official and private use

1600 cc capacity.

2.

Petrol Limit

430 litre per month.

3.

TA/DA on domestic official tour

As admissible to civil servants of highest grades.

4.

TA/DA on domestic official abroad

As admissible to civil servants in Cat-I.

5.

Medical facilities

Reimbursement of medical and hospitalization charges for self, spouse, and children for treatment received at Government or Government recognized institution in Pakistan.

6.

Leaves

The incumbent shall earn leave on full pay @ 3 days per month for the period of duty. The leave shall be availed during the currency of contact period. Title to leave shall expire on expiry of earned leave available in respect of the previous contract shall not be carried forward.

 

 

 

 

 

 

CONTRACT PERIOD ETC.

Period of Contact

Three years.

2.

Termination of Contract

On one month’s notice on either side or payment of one month’s pay in lieu thereof.

3.

Gratuity

One month’s pay for each completed year of service.
