ACT XXXII OF 2021

An Act to amend the Lahore Ring Road Authority Act, 2011.

No. PAP/Legis-2(113)/2021/2641. The Lahore Ring Road Authority (Amendment) Bill 2021, having been passed by the Provincial Assembly of the Punjab on September 30, 2021, and assented to by the Governor of the Punjab on October 01, 2021, is hereby published as an Act of the Provincial Assembly of the Punjab.

It is necessary to amend the Lahore Ring Road Authority Act, 2011 (XVII of 2011) to make provisions for inter alia extending the scope of the Authority to the entire Province of the Punjab.

Be it enacted by Provincial Assembly of the Punjab as follows:

  1. Short title and commencement.–(1) This Act may be cited as the Lahore Ring Road Authority (Amendment) Act, 2021.

(2) This Act shall come into force at once. it a

  1. Amendment of Act XVII of 2011.–In the Lahore Ring Road Authority Act, 2011 (XVII of 2011), for brevity referred to as ‘the Act’:

(a)      for the long title, the following shall be substituted:

“to provide for establishment of the Punjab Ring Road Authority.”;

(b)      for the preamble, the following shall be substituted:

“It is necessary to establish the Punjab Ring Road Authority for planning, designing, development, management, operation and maintenance of ring roads, strategic roads and economic corridors connected thereof, in a smooth, efficient and futuristic manner to improve intercity and intercity connectivity through such roads and to make provisions for the ancillary matters.

Be it enacted by Provincial Assembly of the Punjab as follows:”;

(c)      for the words “the Act” wherever appearing the words “this Act” shall be substituted;

(d)      in Sections 1, 2, 3, 7, 16 and 34, for the words “Lahore Ring Road”, the words “Punjab Ring Road” shall be substituted;

(e)      in Sections 11 and 30 the word “Executive” wherever appearing shall be omitted; and

(f)       in Sections 4, 5, 8, 20, 32 and 36 for the words “Lahore Ring Road and the strategic roads”, and the words “Lahore Ring Road or a strategic road”, wherever appearing, the words “ring roads, strategic roads and economic corridors connected thereof shall be substituted.

  1. Amendment of Section 2 of act XVII of 2011.–In the Act, in Section 2;

(a)      after clause (d), the following clause (dd) shall be inserted:

(dd)    “economic corridor” means a corridor designed to stimulate economic development either through creation of a connecting road or designated area for trade, manufacturing, logistic facilities to reduce unplanned industrialization and commercialization trends along the roads, providing ease of access and reduce traffic burden within cities;

(b)      for clause (g), the following shall be substituted:

(g)      “ring road” means any ring road or part thereof constructed under this Act:

Provided that the revenues generated therefrom shall be utilized on the same ring road;

(c)      for clause (h), the following shall be substituted:

(h)      “prescribed” means prescribed by the rules or the regulations made or framed under this Act;

(d)      in clause (m), for the letter “a”, the word “the” shall be substituted;

(e)      in clause (n), the word “Second” shall be omitted; and

(f)       for clause (o), the following shall be substituted:

“(o)     “strategic road” means any road assigned by the Government to the Authority with any of the powers and functions specified therein:

Provided that the revenues generated therefrom shall be utilized on the same strategic road.”

  1. Amendment of Section 3 of Act XVII of 2011.–In the Act, in Section 3, in sub-section (3), after the word “Lahore”, the words “with regional offices in such other cities as the Authority may deem appropriate” shall be inserted.
  2. Amendment of Section 4 of Act XVII of 2011.–In the Act, in Section 4:

(a)      in sub-section (2), in clause (r), the word “and” shall be omitted; and

(b)      in clause (s), for the full stop at end, the expression “; and” shall be substituted, and thereafter, the following clause (t) shall be added:

“(t)     impose, levy and collect fines, fees, rents, penalties, surcharges and charges as may be prescribed.”

  1. Amendment of Section 5 of Act XVII of 2011.–In the Act, in Section 5, in sub-section (2), in clause (ii), the words “in the field of road infrastructure” shall be omitted.
  2. Amendment of Section 6 of Act XVII of 2011.–In the Act, in Section 6:

(a)      in sub-section (1), for the word “Government”, the word “President” shall be substituted;

(b)      in sub-section (2), for the word “Government”, the word “Council” shall be substituted;

(c)      for sub-section (3), the following shall be substituted:

“(3) The Chairperson may approve a project of development, maintenance, rehabilitation and construction of not more than one hundred million rupees or may recommend for approval a proposal, scheme or project exceeding one hundred million rupees to the Board.”

  1. Amendment of Section 7 of Act XVII of 2011.–In the Act, in Section 7,–

(a)      in sub-section (2), in clause (vi), after the words “A Chartered Accountant”, the words “or an Economist” shall be inserted;

(b)      in sub-section (2), in clause (vi) the word “and” shall be omitted;

(c)      in clause (vii), for the full stop at end, the expression “; and” shall be substituted, and thereafter, the following clause (viii) shall be added:

“(viii) Any other member co-opted by the Council.”;

(d)      in sub-section (3), for the word “Government” wherever appearing the word “Council” shall be substituted, and after the words “a Chartered Accountant”, the words “or an Economist” shall be inserted.

  1. Amendment of Section 9 of Act XVII of 2011.–In the Act, in Section 9:

(a)      in sub-section (2), for clauses (f) to (k), the following shall be substituted:

(f)       Director General of concerned Development Authority;    Member

(g)      Deputy Commissioner of concerned District;         Member

(h)      Chief Engineer, Punjab Ring Road Authority;        Member

(i)       Director (Planning) of the Authority;                     Member

(j)       Concerned Project Director;          Member

(k)      Director Finance and Admin of the Authority;      Member/
Secretary

(l)       an expert of highways and transport engineering; and      Member

(m)     any other member co-opted by the Board.”;

(b)      in sub-section (4), for the word “Government”, the word “Council” shall be substituted; and

(c)      sub-section (8) shall be omitted.

  1. Amendment of Section 10 of Act XVII of 2011.–In the Act, in Section 10:

(a)      in clause (a), after the word “project” the words “funded by the Government” shall be inserted;

(b)      for clause (b), the following shall be substituted:

“(b)     recommend a scheme or project of more than two hundred million rupees for funding and approval by the Government;”; and

(c)      in clause (e), after the word “Authority”, the words “upto five hundred million rupees or as may be delegated by the Council” shall be inserted.

  1. Amendment of Section 14 of Act XVII of 2011.–In the Act, in Section 14, in sub-section (1), for the word “Authority”, the word “Board” shall be substituted.
  2. Amendment of Section 18 of Act XVII of 2011.–In the Act, in Section 18, in sub-section (4), after the word “Council”, the words “or the Board within the limits under this Act” shall be inserted:
  3. Amendment of Section 23 of Act XVII of 2011.–In the Act, in Section 23:

(a)      in sub-sections (1) and (3), the word “Second” shall be omitted;

(b)      in sub-section (1), after the word “him”, the words “in the prescribed Form or through prescribed electronic challan or any other means as may be approved by the Board” shall be inserted; and

(c)      in sub-section (3), after the word “Form”, appearing third time, the words “or through electronic transaction as mentioned in the Form or electronic challan or any other means as may be approved by the Board” shall be inserted.

  1. Amendment of Section 40 of Act XVII of 2011.–In the Act, in Section 40, for the letter “a”, the word “the” shall be substitute.
  2. Omission of First Schedule of Act XVII of 2011.–In the Act, First Schedule shall be omitted.
  3. Renumbering and amendment of Second Schedule of Act XVII of 2011.–In the Act, for the Second Schedule, the following Schedule shall be substituted.

(i) Actual Cost of restoration along with five thousand as fine.
(ii) Repetition of same offence. (ii) Actual Cost of restoration along with ten thousand as fine.
4 (i) Keeping or maintaining any cattle, without permission in writing of the Authority, in any part of a ring road or strategic road or economic corridor connected thereof failure to remove the cattle within the specified time. (i) One thousand per day.
(ii) Repetition of same offence. (ii) Double amount of fine
5 (i) Obstructing or tampering with the ring road, drain, electrical system or pavement of a ring road or a strategic road or economic corridor connected thereof. (i) Actual Cost of restoration along with five thousand as fine.
(ii) Repetition of same offence. (ii) Actual Cost of restoration along with ten thousand as fine.
6 (i) Obstructing or tampering with any main pipe, meter or any apparatus or appliance for the sewerage system. (i) Actual cost of restoration along with five thousand as fine.
(ii) Repetition of same offence. (ii) Actual cost of restoration along with ten percent of cost of restoration as fine.
7 Without the previous sanction of the Authority:

(i) laying out a drain or altering any drain in ring road.

(i) Actual cost of restoration along with ten thousand as fine.
(ii) connecting any house drain with a drain of a ring road or a strategic road or economic corridor connected thereof. (ii) Actual cost of Restoration along with ten thousand as fine.
8 Without permission in writing of the Authority:

(i) Excavation of earth, stone or any other material within such distance of a ring road or a strategic road or economic corridor as may be notified by the authority.

(i) Actual Cost of Restoration along with five thousand as fine.
(ii) Repetition of same offence. (ii) Actual cost of! restoration along with ten thousand as fine.
9 (i) Throwing or placing any refuse, litter or garbage on a ring road or a strategic road or economic corridor connected thereof. (i) Actual cost of removal alongwith five thousand as fine.
(ii) Dumping of garbage. (ii) Actual cost of removal along with ten thousand as fine.
10 (i) Failure to provide arrangement for disposal of litter or garbage inside or outside a shop at a ring road or a strategic road or economic corridor connected thereof (i) Five thousand.
(ii) inadequate arrangement of collecting and disposal of litter or garbage on or inside the right-of-way of Authority. (ii) Actual cost of removal along with five thousand as fine.
(iii) Running of business, collecting or dumping hazardous or dangerous material on a ring road or a strategic road or economic corridor connected thereof. (iii) Actual cost of removal along with five thousand as fine.
11 (i) Failure to stop leakages of water pipes, faucets and sanitary fittings resulting in dirty water pools affecting road structure. (i) Actual cost of damage and repair along with five percent of actual cost of repair as fine.
12 (i) Exhibiting, without the previous approval in writing of the Authority, any advertisement in shape of flex, cloth banner and paper poster at a ring road or a strategic road or economic corridor connected thereof. (i) Five thousand along with actual cost of removal as fine.
(ii) Billboards and LED or VIDEO boards including holding installed along ring road or a strategic road or economic corridors connected thereof without permission of the Authority and likely to be dangerous for ring road or strategic road or economic corridors connected thereof or its commuters. (ii) Actual cost for removal of board along with twenty thousand as fine.
(iii) Any advertisement activity Likely to distract or affect the commuters. (iii) Two thousand along with actual cost of removal
