PUNJAB ACQUISITION OF LAND (HOUSING) (REPEAL) (AMENDMENT) ORDINANCE, 2002

An ordinance to amend the Punjab Acquisition of Land (Housing) (Repeal) Act, 1985.
Whereas it is expedient to amend the Punjab Acquisition of Land (Housing) (Repeal) Act, 1985 (XII of 1985), for the purposes hereinafter appearing;
And whereas the Provincial Assembly of the Punjab is dissolved and the Governor is satisfied that circumstances exist which render it necessary to take immediate action;
And whereas under Article 4 of the Provisional Constitution (Amendment) Order No. 9 of 1999, as amended by the Chief Executive Order No. 11 of 2000, the Governor of a Province may issue and promulgate an Ordinance;
Now, therefore, in exercise of the aforesaid powers and all other powers.
1. Short title and commencement.- (1) This Ordinance may be called the Punjab Acquisition of Land (Housing) (Repeal) (Amendment) Ordinance, 2002.
(2) It shall be deemed to have come into force on and from the 14th Day of August, 2001.
2. Amendment in section 3 of Act XII of 1985.- In section 3 of the said Act, full stop at the end of second proviso shall be substituted by a colon and thereafter the following shall be added:-
“Provided further that for the purpose of operation of this section the following provisions of the Punjab Acquisition of Land (Housing) Act, 1973 shall be read as mentioned hereunder:-
1. In the Preamble the words “urban and rural areas of” shall be deemed to have been deleted.
2. In section 2 sub section (1)-
(i) clause (a) shall be read as:-
“Collector” means collector appointed under the Punjab Land Revenue Act, 1967 (XVII of 1967) and includes any other officer specially empowered by the Board of Revenue to perform the functions of a Collector;”
(ii) clause (b) shall be read as:-
“Executive District Officer (Revenue)” means the Officer Incharge of Group of District Offices as specified in Part-C of First Schedule of Punjab Local Government Ordinance, 2001 under the head “Revenue”;”
(iii) clause (c) shall be read as:-
“District Officer (Revenue)” means the Officer Incharge of the Land Revenue Office at the district level;”
(iv) sub clause (ii) of clause (f) shall be read as:-
“Local Councils constituted under the Punjab Local Government Ordinance, 2001;”
(v) clauses (h) and (i) shall be deemed to have been omitted.
3. In section 6 sub-section (1) the words “Government intends” shall be read as:-
“Government or the official Department Agency, as the case may be, intends”
4. In sections 4, 14, 18 and 19 the word “Commissioner” wherever occurring shall be read as Executive District Officer (Revenue).
5. In sections 4, 13, 17 and 19 the word “Deputy Commissioner” wherever occurring shall be read as District Officer (Revenue).
