PUNJAB CIVIL SERVANTS (AMENDMENT) ORDINANCE, 2002

An Ordinance further to amend the Punjab Civil Servants Act, 1974.

 

Whereas it is expedient further to amend the Punjab Civil Servants Act, 1974 (VIII of 1974), in the manner hereinafter appearing; 

 

And whereas the Provincial Assembly of the Punjab is dissolved and the Governor is satisfied that circumstances exist which render it necessary to take immediate action; 

 

And whereas under Article 4 of the Provisional Constitution (Amendment) Order No. 9 of 1999, as amended by the Chief Executive Order No. 11 of 2000, the Governor of a Province may issue and promulgate an Ordinance. 

 

Now, therefore, in exercise of the aforesaid powers and all other powers enabling him in that behalf, the Governor of the Punjab is pleased to make and promulgate the following Ordinance:- 

 

1.         Short title and commencement.- (1) This Ordinance may be called the Punjab Civil Servants (Amendment) Ordinance, 2002. 

(2)      It shall come into force at once. 

 

2.         Addition of sections 22-A and 22-B in Act VIII of 1974.- In the said Act, after section 22, the following new sections shall be added:- 

22-A. Indemnity.- No suit, prosecution or other legal proceedings shall lie against a civil servant for anything done in his official capacity which is in good faith done or intended to be done under this Act or the rules, instructions or directions made or issued thereunder

“22-B. Jurisdiction barred.- Save as provided under this Act and the Punjab Service Tribunals Act, 1974 (IX of 1974), or the rules made thereunder, no order made or proceedings taken under this Act, or the rules made thereunder by the Governor or any officer authorized by him shall be called in question in any Court and no injunction shall be granted by any Court in respect of any decision made, or proceedings taken in pursuance of any power conferred by, or under, this Act or the rules made thereunder.”
