An Act to amend the Punjab Seed Corporation Act, 1976

No. PAP/Legis-2(147)/2022/52.–The Punjab Seed Corporation (Amendment) Bill 2022, originally passed by the Provincial Assembly of the Punjab on the 12th day of September 2022, was sent to the Governor of the Punjab for assent. The Governor returned the Bill for reconsideration by the Assembly. The Provincial Assembly of the Punjab, after reconsideration, again passed the Bill on the 19th day of October 2022. The Bill was again sent to the Governor and assented to by the Governor of the Punjab on October 27, 2022, is hereby published as an Act of the Provincial Assembly of the Punjab.

It is necessary to amend the Punjab Seed Corporation Act, 1976 (X of 1976) for the purposes hereinafter appearing:

Be it enacted by Provincial Assembly of the Punjab as follows:

  1. Short title and commencement.–(1) This Act may be cited as the Punjab Seed Corporation (Amendment) Act 2022:–

(2) This Act shall come into force at once. ‘

  1. Amendment of Section 4 of Act X of 1976.–In the Punjab Seed Corporation Act, 1976 (X of 1976), for brevity referred to as ‘the Act’, in Section 4:

(a)      for sub-section (3), the following shall be substituted:

(3) The Board shall consist of the following:

(a) Minister for Agriculture of the Government; Chairman
(b) Secretary to the Government, Agriculture Department; Member
(c) Secretary to the Government, Finance Department; Member
(d) two members of Provincial Assembly of the Punjab to be nominated by the Speaker of the Assembly; Members
(e) two persons from the private sector having expertise in the field of agribusiness industry; Members
(f) three persons from the farming community, registered with the Punjab Seed Corporation, including at least one female; Members
(g) one person from the private sector having expertise in the field of finance; Member
(h) one person from the private sector having expertise in the field of finance: Member
(i) one person from the private sector having expertise in the field of information technology; Member
(j) two persons from the faculty of a public or private sector university, having expertise in the field of Agriculture Economics or Crop Sciences; Members
(k) one renowned scientist involved in Agricultural Research (Crop Sciences; and Member
(l) Managing Director Member

(b)      for sub-section (4), the following shall be substituted:

          (4) The members mentioned at clauses (e) to (k) of sub-section (3) shall be nominated by the Chief Minister for a term not exceeding three years.”; and

(c) in sub-section (5), for the word “Government”, the word “Chief Minister” shall be substituted.”.

  1. Substitution of Section 5 of Act X of 1976.–In the Act, for Section 5, the following shall be substituted:

“5. Managing Director.–(1) The Chief Minister, on the recommendation of the Board, shall appoint a Managing Director in such manner as may be prescribed and he shall be the Chief Executive of the Corporation.

(2) The Managing Director shall:

(a)      be a whole-time officer of the Corporation and he shall organize and manage its day to day functions in such manner as may be prescribed;

(b)      perform such other duties as may be assigned to him by the Board; and

(c)      receive such salary and allowances as may be prescribed.”.

  1. Amendment of Section 6 and 7 of Act X of 1976.–In the Act, in Section 6 and 7, for the word “Government” wherever appearing, the words “the Chief Minister” shall be substituted.
  2. Amendment of Section 13 of Act X of 1976.–Inthe Act, in Section 13, insub-section (2), for the word “four”, occurring twice, the word “seven” shall be substituted.
