Can offer be accepted through silence?

A. As per Section 3 of the Contract Act 1872, an offer cannot be accepted through silence. An offeree who does nothing in response to an offer is not bound by its terms, even if the offer specifies that it can be accepted by silence. This principle ensures that no one can impose a contract on an unwilling party. The offeree must actively communicate acceptance for a contract to be valid. Hence, without a clear and communicated acceptance, no contract is formed, protecting the interests and consent of both parties involved.
