Question: How to file Application under section 12(2)?

Answer:           A Simple application file before the same suit, and not a fresh suit is required, when an application made in a court under S.12 (2) CPC, Court shall inquire into the allegation made in the application and the dismissal of an application without holding an inquiry into allegations made in the application is illegal.
