DISPOSAL OF LAND BY DEVELOPMENT AUTHORITIES (REGULATION) (THIRD AMENDMENT) ORDINANCE, 2002

An ordinance further to amend the Disposal of Land by Development Authorities (Regulation) Act, 1998.

 

Whereas it is expedient further to amend the Disposal of Land by Development Authorities (Regulation) Act, 1998 (XII of 1998), for the purposes hereinafter appearing;

 

And whereas the Provincial Assembly of the Punjab is dissolved and the Governor is satisfied that circumstances exist which render it necessary to take immediate action;

 

And whereas under Article 4 of the Provisional Constitution (Amendment) Order No.9 of 1999, as amended by the Chief Executive Order No.11 of 2000, the Governor of a Province may issue and promulgate an Ordinance;

 

Now, therefore, in exercise of the aforesaid powers all other powers enabling him in that behalf, the Governor of the Punjab is pleased to make and promulgate the following Ordinance:- 

 

1.         Short title and commencement. (1) This Ordinance may be called the Disposal of Land by Development Authorities (Regulation) (Third Amendment) Ordinance, 2002.

(2) It shall come into force at once.

2.         Amendment in section 4 of Act XII of 1998.- In the said Act, in section 4-  

(i)      In clause (a) after semi colon at the end the following proviso shall be added:- 

“provided that allotment of 3 to 5 marla residential units, multi-storey flats/apartments shall be made through ballot;” and 

         (ii)     In clause (b) sub clause (1) in column three, under the heading “percentage”,

                     the figures “95%”, “3.5%” and “1.5%” at serial Nos. (i), (ii) and (iii) shall

                      respectively be substituted by the figures “93%”, “5%” and “2%”.
